Prior to accessing the Database, I will select a unique User Identification ("User Name"); and corresponding password. I understand that I have sole responsibility for the security of the username/password issued to me. I am solely responsible for notifying CARE Foundation, Inc. of the loss, theft, or disclosure of a username/password by the most expeditious means available as soon as I become aware of such event. Username/Passwords not used for one (1) year are subject to cancellation without prior notice and to maintain the integrity of the Database, I will be prompted to change my password on a periodic basis defined by CARE.

I understand that I remain the owner of all information I submit to the Database and that I am solely responsible for the accuracy, truth, and veracity of all information I provide, and will not knowingly enter false information. If I learn that information provided is incorrect or no longer accurate, I shall make reasonable effort to update that information or notify CARE in a timely fashion. I understand that I will not be liable for unknown mistakes in the information provided.

Upon submission of information to the Database, I grant to CARE Foundation, Inc. an irrevocable license to provide access to the information to others authorized by CARE Foundation, Inc.

I agree that CARE Foundation, Inc., its suppliers, subcontractors, affiliates, employees, and directors shall not be liable for any delays or failures in performance or for any interruption of service arising from any cause or circumstance beyond its reasonable control and further agree to indemnify and hold CARE Foundation, Inc., its suppliers, subcontractors, affiliates, employees, and directors harmless from any loss or claims arising out of the use of the Database or any materials provided under this Agreement.

I agree that this Agreement shall be governed by the laws of the state of Texas.

CARE FOUNDATION, INC. MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WITH RESPECT TO SERVICES OR DATA MADE AVAILABLE BY PROVIDER, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY. CARE FOUNDATION, INC. ASSUMES NO RESPONSIBILITY WITH RESPECT TO ANY USE OF ANY OF THE SERVICES OR DATABASES MADE AVAILABLE BY CARE FOUNDATION, INC. USER OF THE DATABASE AGREES CARE FOUNDATION, INC. AND ITS SUPPLIERS, SUBCONTRACTORS, EMPLOYEES, AND DIRECTORS SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES OR FOR THE LOSS OF PROFIT, REVENUE, OR DATA ARISING OUT OF THE SUBJECT MATTER OF THIS AGREEMENT.
